Course Introduction

Welcome to the comprehensive training programme on the Administrative Adjudication of Road Traffic Offences (AARTO) Act and Corporate Proxy Management.

 

The national rollout of the AARTO system represents the most significant overhaul of road traffic law enforcement in South African history. Moving away from the traditional, purely financial penalty framework governed by the Criminal Procedure Act, AARTO introduces an administrative, data-driven system built around a strict Points Demerit System. The infringement notice, courtesy letter, and enforcement order framework is now live in 62 participating municipalities as of 1 July 2026, with the national demerit points phase still to follow. Organisations therefore need to be compliant with the live infringement process today, while preparing for the demerit points system once it is rolled out nationally.

 

The ultimate objective of AARTO is simple: to reduce road fatalities and change driver behaviour. However, for organisations operating a fleet — whether it is pool cars, a sales team on the road, or a large-scale logistics network — AARTO fundamentally changes corporate risk profile, human resource structures, and operational liabilities. If left unmanaged, the consequences for the organisation include:

  • Asset Immobilization: Demerit points accumulate not just against drivers, but against Operators (companies). Exceeding point thresholds can result in the automatic suspension or cancellation of vehicle licences and Operator Cards, legally grounding entire fleets.
  • Third-Party Liability & Insurance Risks: If an employee drives a company vehicle with a suspended licence and causes an accident, corporate insurance policies may be declared null and void, exposing the business to millions of Rands in liability.
  • Operational & Financial Disruption: Warrants of Execution arising from unresolved Enforcement Orders can legally allow sheriffs to seize moveable corporate property.

Course Objectives

The objective of this Proxy and AARTO Training Program is for course participants to become familiar with the following:

  • Deconstruct the AARTO Act and distinguish its mechanisms clearly from the Criminal Procedure Act (CPA) still used in non-rollout areas
  • Explain the lifecycle of an infringement, from the initial Infringement Notice to the Courtesy Letter, Enforcement Order, and the final Warrant of Execution
  • Interpret the 32-day rule strictly, identifying the critical legislative timelines and deadlines for responding to notices to avoid automatic escalation
  • Define the legal roles and responsibilities of a judicially nominated Company Proxy under the National Road Traffic Act and AARTO
  • Mitigate corporate risk by establishing an airtight framework to shield the company’s Operator Card (and corporate fleet) from suspension
  • Successfully execute the driver nomination process, transferring demerit points from the corporate entity to the actual driver responsible for the infringement within the lawful timeframe
  • Navigate the Road Traffic Infringement Agency (RTIA) portal to audit, track, and monitor the demerit status of both corporate vehicles and employed drivers
  • Assess the legal options available for contesting an infringement, including representation, electing to go to court, or applying for instalment payments
  • Formulate a standard operating procedure (SOP) for internal mailroom and fleet administration teams to ensure notices are captured, date-stamped, and escalated immediately upon receipt
  • Develop an AARTO-compliant Workplace Policy that seamlessly integrates into existing Employment Contracts and Disciplinary Codes
  • Design a driver risk-profile matrix using telematics data and infringement histories to proactively identify high-risk drivers before they reach the licence suspension threshold
  • Manage the operational impact of driver licence suspensions, establishing lawful protocols for handling employees who can no longer legally drive for the organisation
