This seminar focuses on how tenders are issued by government departments, how suppliers should compile and submit their bids, and how tenders are evaluated and awarded to the successful bidder.

Orientation to the current regulatory landscape, preparing a responsive bid, and understanding scoring, B-BBEE, and pricing — the practical essentials a first-time or emerging tenderer needs most urgently.

Course Objectives

Delegates will learn how to effectively complete responsive and acceptable bid documents. Classroom exercises will show delegates how tenders are scored, giving them insight into what takes place during the evaluation and adjudication stages of the tendering process. Suppliers will also be advised on how to claim incentive points under the Preferential Point Systems applicable to all tenders.

  • Brief orientation to the current regulatory framework: PPPFA, the 2022 Preferential Procurement Regulations, and B-BBEE requirements as they currently apply
  • Public Sector Standard Bidding Documents (SBDs) and how to complete them correctly
  • How to prepare a responsive bid/tender proposal, and the do's and don'ts of tendering
  • Tax clearance certificates and other compliance attachments to the bid document
Afternoon: Scoring, B-BBEE, and Pricing
  • The 80/20 and 90/10 preference point systems, explained practically
  • How B-BBEE status affects your points and contract award
  • How to work out a competitive, correctly costed tender price
  • Close-out: your personal tender-readiness checklist, and deciding whether the 3-Day Comprehensive is the right next step

3-Day Comprehensive — Training Outline

Day 1: Regulatory Framework and Understanding the Tendering Process
Understanding the Basic Regulations and Legislation Governing Procurement
  • The Constitution of the Republic of South Africa, and the Public Finance Management Act, 1999
  • The Municipal Systems Act, 2000, and the Municipal Finance Management Act, 2003
  • The Preferential Procurement Policy Framework Act (PPPFA), 2000, and the current Preferential Procurement Regulations, 2022 (the 2017 Regulations were struck down by the Constitutional Court and repealed, and are no longer in force)
  • The Public Procurement Act, 2024: currently in phased implementation, and set to eventually repeal the PPPFA — practitioners should confirm current commencement status with National Treasury
  • The Broad-Based Black Economic Empowerment Act, 2003, and National Treasury's Supply Chain Management Regulations
  • The General Procurement Guidelines (the Five Pillars of Procurement)
  • The National Small Enterprise Act, 1996 (formerly the National Small Business Act), significantly amended in 2024 to establish the Small Enterprise Development and Finance Agency (SEDFA), consolidating Sefa, Seda, and the Cooperative Banks Development Agency

Day 2: Preparing and Submitting a Responsive Bid
Tender & Bid Implementation
  • Public Sector Standard Bidding Documents (SBDs) and how to complete them correctly
  • How to prepare a responsive bid/tender proposal
  • Joint ventures, consortiums, and sub-contracting, and how to utilise them
  • Tax clearance certificates and other compliance attachments to the bid document
  • Identifying the exact demand for goods and services: the do's and don'ts of tendering
Understanding Tender Conditions and Preparation
  • Understanding the general and special conditions of the tender
  • Defining the scope of the technical specifications
  • Ascertaining the presence of pre-qualifications
  • Preparing for briefings and site visits
  • Scheduling the process/phases as outlined in the tender document
  • Understanding the terms and conditions of the contract
Day 3: B-BBEE, Scoring, and Pricing
B-BBEE and Preferential Procurement
  • B-BBEE procurement regulations for all suppliers doing business with government or planning to submit tenders
  • Assessing targeted procurement levels within the tender
  • Currency note: draft amendments to the B-BBEE Codes were published for public comment on 29 January 2026, described as the most significant proposed B-BBEE policy shift since 2013, including changes to preferential procurement scoring — suppliers should plan for this direction of travel while understanding it is not yet finalised or binding
