Course Introduction

Legal appointments in the mining industry have never been as critical as they are today. Operations face increasing scrutiny over whether their appointment structures and appointment letters genuinely establish compliance and effective delegation, rather than simply existing on paper. This MHSA Legal Appointment course covers the need for legal appointments under the Mine Health and Safety Act (MHSA) and the Occupational Health and Safety Act (OHSA), the legal structures behind them, the distinction between legally required and best-practice appointments, and the practical skills needed to draft sound appointment letters and structures.

Course Objectives

Upon completion of this MHSA Legal Appointment course, participants will be able to:

  • Explain the legal need for appointments, and the role of competence, authority, and control in establishing a valid appointment
  • Design legal appointment structures appropriate to the size and complexity of a mining operation
  • Distinguish between legally required appointments and appointments made as a matter of best practice
  • Apply OHSA appointment requirements within a mining environment, alongside MHSA appointments
  • Distinguish mandatory from voluntary appointments, and the consequences of getting this wrong
  • Draft appointment letters that meet the minimum legal requirements, and structure appointments defensibly in practice

  • Why legal appointments matter: delegation, accountability, and the risk of vicarious liability where appointments are poorly structured
  • The legislative framework: the Mine Health and Safety Act (MHSA) and its Regulations, and the Occupational Health and Safety Act (OHSA), and how each applies to appointments on a mine
  • Understanding the need for appointments: competence, authority, and control as the legal tests for a valid appointment
  • Legal appointment structures: how the size and complexity of an operation affects the appointment structure, from the Chief Executive Officer and Mine Manager down through appointed managers and supervisors
  • Practical Exercise: map a simplified legal appointment structure for a hypothetical mining operation, and identify the gaps in a sample structure

Afternoon Session — Mandatory, Voluntary, and OHSA Appointments, and Drafting Appointment Letters
  • Objective: distinguish categories of appointment, and build the practical skills to draft legally sound appointment letters.
  • Legally required versus best-practice appointments: distinguishing appointments mandated by the MHSA from appointments made as a matter of good governance
  • Mandatory versus voluntary appointments, and the consequences of treating one as the other
  • OHSA appointments in the mining environment: where OHSA appointments apply alongside MHSA appointments, and avoiding duplication or conflict between the two
  • Appointment letters as legal documents: minimum requirements, including scope of authority, duties and responsibilities, competency confirmation, and acceptance by the appointee
